By registering for the McDougall 12-Day Program (“Program”), you agree to the following Terms of Service (“Terms”). Please read carefully before completing your enrollment.

1. Program Overview

The 12-Day McDougall Program is a medically guided lifestyle program focused on improving health through whole food, starch-based nutrition, professional medical care and ongoing support.

Enrollment includes:

• Three one-on-one medical appointments with a Lifestyle Telemedicine physician (a partner of McDougall Health & Medical Center).
  
• Live lectures and Q&A sessions with the McDougall Team, including licensed doctors and health experts.
  
• Daily support during the 12 days, followed by structured follow-ups for 12 months.
  
• Access to educational resources, cooking demonstrations, meal plans, and a private online community.
  
  

This program provides medical and lifestyle education designed to support your wellness goals. It is not a replacement for your existing physician or emergency care.

2. Medical Disclaimer

All medical consultations are conducted by independent, board-certified physicians through Lifestyle Telemedicine.

These physicians are solely responsible for your individualized medical care, diagnosis, and treatment. McDougall Health & Medical Center does not supervise or employ these doctors but collaborates to ensure coordinated, evidence-based care.

You acknowledge that:

• Participation does not create a doctor–patient relationship with McDougall Health & Medical Center.
  
• You should consult your personal healthcare provider before making changes to medications, diet or lifestyle.
  
• In case of an emergency, you must contact your local emergency services.
  
  

3. Participant Responsibilities

By enrolling, you agree to:

• Provide complete and accurate health and personal information.
• Attend scheduled appointments and participate actively in the program.
• Follow the recommendations of your Lifestyle Telemedicine physician and the McDougall team as appropriate.
• Use your own discretion when applying educational materials.
• Refrain from sharing or reproducing proprietary Program materials, recordings or digital resources without written permission.
• Maintain secure technology and internet access for online sessions.
  
  

Participation is personal and non-transferable. You may not assign or share your enrollment with another person.

4. Payment & Refund Policy

Full payment is required to secure your place.

If you cancel your enrollment:

• Cancellations made at least 7 days prior to the Program start date will receive a refund minus a $250 USD administrative fee.
• No refunds will be issued within 7 days of the start date or once the Program begins.
  
  

Refunds are processed to the original payment method within 10 business days. Because space is limited and medical and staffing resources are pre-allocated, exceptions cannot be made.

5. Privacy & Confidentiality

Your privacy is important to us.

• All medical consultations comply with HIPAA and applicable privacy laws.
• Medical information shared with Lifestyle Telemedicine is confidential and used only for your care.
• Participation in live sessions may include video or audio presence. By joining, you consent to being visible or heard in group discussions.
• Program data may be used in aggregate form (never personally identifiable) for research or quality improvement.

6. Intellectual Property

All materials, including lectures, slides, videos, recipes, handouts and other content provided during or after the Program, are the intellectual property of McDougall Health & Medical Center or its partners.

You may use these materials for personal education only. Reproduction, resale or public sharing of any content without express written permission is prohibited.

7. Program Modifications

We reserve the right to adjust schedules, speakers, or program content as needed to ensure quality and continuity.

If a session or lecturer must be changed, we will make reasonable efforts to provide equivalent value.

In the rare event the Program is postponed or canceled, participants may choose to transfer to a future session or receive a full refund.

8. Force Majeure

The McDougall Program shall not be liable for delays, rescheduling or cancellations due to events beyond our reasonable control, including but not limited to natural disasters, power outages, illness of instructors, acts of God, war or internet interruptions.
We will make every reasonable effort to resume or complete the Program once conditions permit.

9. Results & Limitation of Liability

Individual results vary. The McDougall Program, McDougall Health & Medical Center, and Lifestyle Telemedicine make no guarantees of specific outcomes such as weight loss, reduction of medications, or reversal of chronic illness.

By participating, you voluntarily assume all risks associated with your participation and release McDougall Health & Medical Center, its affiliates, and team members from liability for any claims, damages, or losses except where prohibited by law.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.
Any disputes shall be resolved in the state or federal courts located in Sonoma County, California, unless otherwise required by law.

11. Dispute Resolution (Arbitration Clause)

If a dispute arises under these Terms that cannot be resolved through good-faith discussion, both parties agree to resolve the matter through binding arbitration in accordance with the rules of the American Arbitration Association.
Each party shall bear its own legal fees unless otherwise determined by the arbitrator. Arbitration will take place in Santa Rosa, California, or virtually if both parties consent.

12. Non-Transferability

Program enrollment is personal and non-transferable.
You may not assign your participation, access credentials or program materials to another person.
